If You Rent A House That Fails A Building Inspection, Can That Void The Lease?

I was just wondering because i dont know if the house i am renting will pass.
If an inspection uncovered conditions that effect habitability and the Landlord refused to take action the lease could possibly be void. Take pictures for documentation and seek a copy of the inspection report to hold for 3 years. That way if you move out and the Landlord bills you there is recourse.

There is no such thing as a building inspection for an established home. If you were contact the city health department, they would probably consider a health and safety inspection, but those normally just result in a few things that need to be fixed.
The only thing that would void the lease would be if the home was deemed uninhabitable, and that would only be the case if it was not something that could be fixed quickly.

If the inspection was for the purpose of establishing the rental unit safe to occupy, well, it depends.
If it fails inspection, and the landlord can fix what is wrong in a reasonable amount of time…before your lease starts, then no, it does not void the lease.
But if it fails inspection, and the city says the landlord cannot rent it…if you cannot occupy the property by the first day of your rental month, then the landlord breached the contract, and yes, he must refund your ENTIRE deposit and any monies paid out.

well, the question is why is this building being inspected and by whom?
It is possible that the property has outstanding code, or health issues.
The owner may be obligated to make repairs, and may be fined if they are not made.
At the extreme, the building could be deemed unfit for habitation or even comdemed. In either case (if not fixed) you would have to vacate.
There is also the possibility that the owner may want to sell the building and is merely having a home inpection for the purpose of selling the property. In this case read your lease about what happens if anything on sale of the property.
